General Terms and Conditions

1.      Scope of Terms and Conditions

IMaGE Performing Arts Promotion Veranstaltungsorganisations GmbH (hereinafter called "we") does business based on the present Terms and Conditions (hereinafter called "Terms") only. When placing your online order, you automatically accept to be bound by the present Terms. These Terms apply to all domestic and international orders.

2.      Placing of orders

Our products are displayed online at http://www.port-ami.com (hereinafter called "web site"). Prices and product lists shown online reflect our range of products and do not constitute an offer as defined by Article 861 of the Austrian Civil Code, but merely an invitation to request a quote.
 
In order to initiate a business relationship with us, use the contact form provided in the "Shop" section of our web site. You will then make your selection from our range of products and proceed to placing your order. After receiving your order, we will send you an e-mail confirmation to the address you have provided when placing your order. The confirmation will once again show all order details (contracting parties, shipping address, ordered products, purchase price and shipping cost).

Verbal orders or verbal agreements and/or changes to your order are not valid unless confirmed by us in writing (e-mail). This also applies to orders based on a written quote provided by us.

3.      Conclusion of contract

The sales contract comes into being at the time we ship the merchandise to you, not upon our confirmation that we have received your order.  In case we are unable to accept the order placed by you or we require changes to the order, we will inform you by e-mail. Unless you explicitly accept the suggested changes, the order will be deemed to be canceled.

Delivery times are displayed alongside the product. Products in stock usually ship between 2 to 6 days. Should actual delivery times substantially differ from those indicated in the shop, we will inform you by e-mail. Unless you explicitly accept the delivery time as indicated in the e-mail, your order will be deemed to be canceled.

All B2C prices include statutory value-added tax. All B2B prices are displayed exclusive of value-added tax. All prices are shown in Euros. Errors excepted. Payments can be made by credit card and bank transfer. Costs for money transfers have to be paid by the client. ( person ordering the goods )

6.      Right to cancel the contract

Should you not be satisfied with your order, you have the right to cancel the contract within 7 business days (Saturday does not count as a business day) after receipt of the merchandise. In order to exercise this right, please return the unopened merchandise at your own expense to IMaGE Performing Arts Promotion Veranstaltungsorganisations GmbH, 1130 Wien, Orangerie im Schloss Schönbrunn, Schönbrunner Schlossstraße 47. We reserve the right to claim compensation for decreased value in case the merchandise has been used. Upon cancellation of the contract, the purchase price will refunded to your account.

The right to cancel the contract does not apply to merchandise that has been custom-made to your specifications.

7.      Data protection

We will not disclose your data to third parties. Personal data is stored and processed for internal and lawful purposes only. You are entitled to requesting information about your data as well as having your data corrected, blocked or deleted. 8.      Damaged merchandise

Damages to goods that evidently occurred in transit are to be claimed with the carrier immediately upon receipt. Claims regarding visible damage must be filed with us within seven days after receipt of the merchandise. Claims filed after this period will not be accepted, unless they are covered by our warranty. The provisions of the Austrian Consumer Protection Act apply to customers.

9.      Warranty

Customers are protected by the relevant provisions of the Austrian Civil Code and the Austrian Consumer Protection Act. If you have received a defective item, we are entitled to remedying the defect in question, either by rectifying or replacing it, whichever you choose. Should this be impossible or should this entail disproportionate costs, you may claim a reduction of the purchase price or you may, in the case of major defects, return the merchandise for a full refund of the purchase price. 10.  Differences

A lot of our products are handcrafted, which makes them one-of-a kind items. As a consequence, pictures shown on the web site might slightly differ from actual items.

11.  Final stipulations

In the event that any provision of these general terms and conditions is determined to be invalid or unenforceable, the validity of all other provisions shall remain unaffected. Any invalid or unenforceable provision shall be replaced with valid and enforceable provisions best reflecting the original intention.

By concluding the contract with us, you explicitly accept to be bound by these Terms. These Terms shall be ruled by Austrian law, excluding its principles on conflicts of law and the UN Sales Convention. Unless you are a consumer as defined by Article 1 of the Austrian Consumer Protection Act, the court of jurisdiction shall be the competent court in 1010 Vienna.
